Recruitment of District Judges Direct Quota in pursuance to advertisement Notification No. 03 of 2024/RG/GS dated 05.06.2024.
NOTIFICATION
In partial modification to High Court Notification No. 03 of 2024/RG/GS dated 05.06.2024, it is hereby notified for the information of all the concerned that the syllabus for the subject written competitive examination as notified vide the notification (supra), stands amended. The modified syllabus is annexed as Annexure-“A” to this notification for information of all the candidates.
SYLLABUS FOR EXAMINATION
UNDER RULE 8 (i)(a)
JAMMU AND KASHMIR HIGHER JUDICIAL SERVICE RULES, 2009
* There shall be two papers carrying 80 marks each.
* The duration of each paper will be of two hours.
* Each paper shall comprise three parts carrying equal number of questions.
* The candidates shall have to attempt nine questions in each paper, three from each part.
PAPER-I
Part-I
(a) Essay- Precise writing
(b) Constitution of India.
(c) Legal Maxims.
(d) Translation of passage in Urdu to English or Hindi to English.
Part-II
a) Judgment Writing on Civil Original & Civil Appellate side.
b) Laws relating to Partnerships, Contracts and Arbitration. Transfer of Property Act 1882, Jammu and Kashmir Agrarian Reforms Act 1976, Jammu and Kashmir State Evacuees (Administration of Property) Act 2006, Jammu and Kashmir Alienation of Land Act 1995 (1938 A. D.) and Specific Relief Act 1963
c) Laws relating to Compensation under the Motor Vehicles Act, 1988.
d) Laws relating to Marriages, Divorce and Succession governing Hindus, Muslims, Christians and Buddhists.
Part-III
a) Civil Procedure Code 1908.
b) Interpretation of Statues.
c) Laws relating to acquisition and requisition of immovable property.
d) Laws relating to Guardianship, Succession Certificate, Probate and Letters of Administration.
e) Laws relating to Eviction of unauthorized occupants from public premises.
PAPER-II
Part-I
a) Code of Criminal Procedure 1973./ Bharatiya Nagrik Suraksha Sanhita, 2023.
b) Indian Penal Code, 1860/ Bharatiya Nyay Sanhita, 2023
c) Juvenile Justice (Care and Protection of Children) Act 2015.
Part-II
a) Judgment Writing on Criminal Original and Criminal Appellate side
b) Indian Evidence Act, 1872/ Bharatiya Sakshya Adhiniyam, 2023
c) Penal Laws in force in the state relating to Arms, Enemies and Terrorist related activities.
Part-III
a) Jammu and Kashmir Civil Service Regulations.
b) General Financial Rules.
c) Medical Jurisprudence.
d) Prevention of Corruption Act, 1988 and Narcotic, Drugs and Psychotropic Substances Act, 1985.
(Note: Any reference to the “laws” in the syllabus given above shall be construed as reference to the laws enforced in the Union Territories of Jammu & Kashmir and Ladakh after the coming into effect of the Jammu and Kashmir Reorganization Act, 2019).
