JKP Constable Posts ā CAT Case Update :As per reports, the CAT has refused to grant an interim stay on the declaration of the final selection list. Reportedly, the JKSSB has been directed to proceed with the process in accordance with the principles laid down in the Saurav Yadav case.
Supreme Court held in Saurav Yadav v. State of UP that merit should always come first in public recruitment, ruling that meritorious reserved category candidates (SC/ST/OBC) who score high enough for general seats must be counted in the general category, not their reserved quota, allowing more reserved seats for others.
This judgment upheld the principle that horizontal reservations (like for women) shouldn’t hinder merit, ensuring fairness and better representation by preventing reserved candidates from taking up reserved slots if they qualify on merit alone.
