Objections Invited on Kathua Homeopathic College Gazetted Rules

Draft Jammu and Kashmir Government Homeopathic Medical College, Kathua (Gazetted) services Recruitment Rules, 2025 – inviting of objections thereof.

Whereas, vide Government order No. 268-JK(HME) of 2025 dated 27.03.2025, 47 posts of different categories were created for Government Homeopathic Medical College Kathua with the following breaking up:

Branch — No. of posts
Teaching Faculty — 13
College Administration — 15
Non-Teaching Staff — 09
Hospital Staff — 10
Total — 47

Whereas, of the aforesaid 47 posts, 21 posts fall under the Gazetted category, while the remaining 26 posts pertain to the Non-Gazetted cadre;

Whereas, with a view to ensuring the smooth functioning of the Government Homeopathic Medical College-cum-Associate Hospital, Kathua, and to provide the institution with the requisite human resources, the Health and Medical Education Department initiated the process of framing Recruitment Rules for the posts created therein;

Whereas, the draft Jammu & Kashmir Government Homeopathic Medical College Kathua (Gazetted) Service Recruitment Rules were placed before the Departmental Committee constituted vide Government Order No. 386-JK(HME) of 2024 dated 20.06.2024, mandated to finalize the Recruitment Rules of subordinate offices under the Health and Medical Education Department;

Whereas, the said Committee, after holding a series of meetings and undertaking detailed deliberations on the matter, has finalized the Draft Jammu and Kashmir Government Homeopathic Medical College, Kathua (Gazetted) Service Recruitment Rules, 2025;

Now, therefore, the Jammu and Kashmir Government Homeopathic Medical College, Kathua (Gazetted) Services Recruitment Rules, 2025 to the Standing Committee in ARI & Trainings Department for consideration and approval, the Draft Notification along with Schedule-I and Schedule-II is hereby published for soliciting objections/suggestions, if any, from all

Notification :

S.O. In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Lieutenant Governor, Union Territory of Jammu and Kashmir hereby makes the following rules, namely:–

1. Short title and Commencement

(1) These rules may be called Jammu and Kashmir Government Homeopathic Medical College Kathua (Gazetted) Service Recruitment Rules, 2025.

(2) These rules shall come into force from the date of publication in the Government Gazette.

2. Definitions

(1) In these rules, unless the context otherwise requires:

a. “Administrative Department” means the Health and Medical Education Department;

b. “Cadre” means the cadre of the service;

c. “Commission” means the Jammu and Kashmir Public Service Commission;

d. “Government” means the Government of Jammu and Kashmir;

e. “Head of the Department” means the Principal/Head of the institution;

f. “Member of the Service” means a person appointed to a post in the service under these rules;

g. “Post” means the permanent post carrying a definite time-scale of pay sanctioned by the competent authority;

h. “Rules” means the Government Homeopathic Medical College, Kathua Gazetted Service Recruitment Rules, 2025;

i. “Schedules” means the schedules annexed to these rules;

j. “Service” means the Government Homeopathic Medical College, Kathua (Gazetted) Service;

k. “UT” means the Union Territory of Jammu and Kashmir.

l. Words and expressions used in these rules but not defined shall have the same meaning as are assigned to it in the Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956 and Jammu and Kashmir Civil Services Regulations, 1956;

3. Constitution of Service

(1) From the date of commencement of these rules, there shall be constituted the Government Homeopathic Medical College, Kathua (Gazetted) Service Recruitment Rules, 2025.
(2) The Government may at the commencement of these rules, appoint to the service any person is eligible for appointment and is holding in a substantive capacity any post included in the cadre of the service.

Explanation: The word “holding” means a person occupying a sanctioned post included in the cadre of the service on regular basis under orders of the Competent authority.

4. Strength and Composition of the Service

(1) The authorized strength of the cadre and nature of the posts included therein shall be specified in the Schedule-I annexed to these rules.

5. Qualification and method of recruitment

(1) No person shall be eligible for appointment or promotion to any post unless he/she possesses the qualification and fulfils other requirements as laid down in Schedule-II.

(2) Appointment to the Service shall be made:
a. By direct recruitment; or
b. By promotion; or
c. By deputation/selection, as specified against each post in Schedule-II.

6. Probation

(1) Probation shall be governed by the Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956.

7. Reservation in appointments

While making appointments either by direct recruitment or by promotion, reservation shall be made in accordance with the provisions of Jammu and Kashmir Reservation Act, 2004 and the rules framed thereunder.

8. Training and Departmental Examination

Persons appointed by direct recruitment shall undergo such training and pass such departmental examination as may be prescribed by the Government.

9. Maintenance of seniority lists

Seniority of the members of the Service shall be maintained and regulated as per the Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956.

10. One time exemption

As one time exemption, in case of non availability of eligible candidates for the post of Principal and Associate Professor, the following exemption shall be made for recruitment to the post of Principal and Associate Professor as under:

A. For the post of Principal:
In case of non availability of eligible members, the selection shall be made from eligible medical officers/Assistant Professors of Government Homeopathic Medical College Kathua having post Graduation in any discipline, with 05 years of administrative experience and total service of minimum 20 years.

B. Post of Associate Professor:
In case of non availability of eligible members from feeder cadre, the post can be filled up as one time absorption by way of lateral entry selection from Health/Ayush Department from amongst the senior medical officers in Homeopathy having not less than 5 years of experience in regular service after acquiring post graduate qualification in subject concerned or any subject if not available having 01 publications as Principal or Co-author in indexed or peer reviewed journal and must have qualified National Teachers Eligibility Test conducted by the commission.

11. Residency Matters

In matters not specifically covered by these rules, the members of the service shall be governed by the rules/regulations applicable to the UT Civil Services in general.

12. Interpretation

If any question arises relating to the interpretation of these rules, the matter shall be referred to the Administrative Department whose decision shall be final.
