Re-imbursement of Trap Money to the complainant, seized by Anti Corruption Bureau, J&K in Trap Cases.
Reference: Letters No. ACB-FIR-Reimbursement-Trap Money-12726 dated 05.07.2022, No. ACB-FIR-Trap money- 11768 dated 10.08.2023, No. ACB-FIR-Reimbursement-Trap money-16625 dated 14.12.2023 and No. ACB-FIR-Trap money-2024-5031 dated 07.05.2024 of Anti Corruption Bureau, J&K.
Government Order No. 425-JK (GAD) of 2025 Dated: 02.04.2025
In supersession of all the previous orders issued on the subject, sanction is hereby accorded to the reimbursement of trap money seized in trap cases by the Anti Corruption Bureau, J&K in accordance with the procedure laid down here under :-
1. The trap amount provided by the complainant will be reimbursed to him in deserving cases.
2. The procedure must ensure that reimbursements are not rushed and are only made after thorough verification of the
case. For the purpose, the complainant needs to move a written application before the SSP concerned of ACB, J&K.
3. The release of trap money should be subject to the authorization of the Director, ACB, J&K and an undertaking
from the complainant, to safeguard the government’s right to recover the trap money once it is released by the court.
4. The reimbursement will be considered, atleast after lapse of 02 (two) months from the date of trap or after the charges are
framed against the accused whatever is earlier.
5. It must be ensured that the chain of custody and evidentiary value of trap money remains intact.
6. The reimbursement of trap money shall be charged to budget head 2070 OAS Sub Head 090- witness expenses.
This issues with the concurrence of the Finance Department and Department of Law Justice & PA conveyed vide U.O No. FD-Code/ 153/2022- 03-746 dated 26.07.2024 and U.O No. LAW-Opn1/68/ 2024 dated 03.12.2024, respectively.
