RTE Act 2009: Private schools directed to provide free education to children in J&K

The government of Jammu and Kashmir has issued a directive to all private unaided schools operating on state land to provide free education to children from disadvantaged sections.

The Directorate of School Education Kashmir (DSEK) has reminded these schools of their responsibility under section 12 (1)C of the Right to Education (RTE) Act to admit at least one-fourth (25%) of the total strength of class 1st primary or pre-school education from weaker sections of their catchment area and provide them with free education.

In an official communication addressed to all Chief Education Officers (CEOs) of Kashmir division, the directorate has instructed the private schools to publicize the admission process and compulsorily admit 25% of students from weaker sections of their catchment area. The CEOs have been asked to furnish a list of private schools functioning on state land.

The directive aims to provide access to quality education to all children, regardless of their socio-economic background, and create a more equitable education system. An official said that the directive is a step towards ensuring that every child has an equal opportunity to learn and grow in top-notch private schools in the Valley.

The government has asked all heads of private schools operating on state land to comply with this directive. The RTE Act-2009 became applicable in J&K after the abrogation of Article 370 from the constitution of India and the reorganization of J&K into a Union Territory (UT).

The applicability of the Act in J&K has raised hopes for children from weaker sections to access education from top-notch private schools, which were previously out of bounds for them.
